Acceptance

By creating an account or using THABER, you agree to these Terms and to the Privacy Policy. If you do not agree, do not use THABER.

Eligibility

THABER’s minimum age is 13. If you are aged 13–17, you may use THABER only with permission from a parent or legal guardian, who must review and agree to these Terms on your behalf. Anyone under 13 may not use THABER, even with a parent’s permission. Where your local law sets a higher age or additional conditions for minors, those apply. By using THABER you confirm you meet these requirements.

Your account

You agree to provide accurate account information and to keep your sign-in credentials secure. You are responsible for activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.

What THABER is

THABER provides human-performance and fitness information and tools — including a training plan that adapts over time, readiness and recovery insights, nutrition targets and logging you confirm yourself, progress tracking, and an AI Coach that answers questions grounded in your data.

THABER gives you information and guidance to support your own decisions. It is not medical care, not a medical diagnosis, not a medical device, and not an emergency service. Use your own judgement, and consider consulting a qualified professional before starting or significantly changing a training or nutrition programme. If you think you may be experiencing a medical emergency, seek emergency medical care immediately.

AI & fitness limitations

THABER uses AI to help explain and phrase guidance and to power the AI Coach. AI can be wrong or incomplete and does not replace professional judgement. Readiness and other safety-relevant scores are produced by THABER’s deterministic logic, and AI wording does not override them.

Physical training carries inherent risks. Train within your abilities, stop if something does not feel right, and seek advice when you need it.

Acceptable use

You agree not to use THABER unlawfully; not to attempt to disrupt, damage or gain unauthorised access to the service or to other users’ information; not to misuse, copy, resell or reverse-engineer the service except as the law allows; and not to submit content that infringes others’ rights.

Your content

You keep ownership of the content you provide, such as your logs, notes and photos. You grant THABER the limited licence needed to host, process and display that content to operate and provide the service to you — including sending relevant context to our service providers as described in the Privacy Policy. You are responsible for the content you submit and confirm you have the right to submit it.

Intellectual property

THABER and its software, design, brand and content are protected by intellectual-property rights and remain ours or our licensors’. These Terms do not grant you any right in them except to use the service as intended.

Connected services & app stores

THABER may let you import data or connect third-party services — for example a health-data file you export, or a supported wearable service. Those services are provided by third parties under their own terms, and their data can be incomplete, delayed or inaccurate; we are not responsible for third-party services.

If you download THABER from the Apple App Store, your use of the app is also subject to Apple’s standard Licensed Application End User License Agreement (EULA). These Terms of Use govern the THABER service in addition to that licence; where the two conflict about the app licence itself, Apple’s standard EULA governs that licence.

Subscriptions & payment

THABER offers a free tier and an optional paid subscription (a Pro plan) that unlocks additional features. If an introductory offer or free trial is available, its terms and eligibility are shown to you at the point of purchase; we do not promise a trial where none is offered.

On Apple devices. If you buy a subscription in the THABER app on an Apple device, the purchase is made through Apple In-App Purchase and billed to your Apple Account. The subscription name, what it includes, the length of the billing period and the price are shown in Apple’s purchase screen, at Apple’s localized price, before you confirm. The subscription renews automatically and is charged to your Apple Account within 24 hours before each period ends, unless you turn off auto-renewal at least 24 hours before then. You manage or cancel it in your Apple Account settings (Settings → your name → Subscriptions), and you can restore a previous purchase from within the app. Refunds are handled by Apple under its policies; requests are made to Apple and we cannot guarantee approval. Deleting the THABER app or your THABER account does not cancel an Apple subscription — you must cancel it in your Apple Account, or Apple will continue to bill you.

On the web. If you subscribe on the web, payment is processed by Stripe, and the price and billing period are shown before you confirm; you can cancel from within THABER to stop future renewals.

In all cases you keep paid access until the end of the current paid period, and THABER does not charge you when you do not have an active paid subscription. Your statutory consumer rights — including any withdrawal or refund rights that apply where you live — are not affected.

Termination & account deletion

You can stop using THABER at any time and can delete your account from within the app; account deletion follows a 30-day grace period before permanent deletion, as described in the Privacy Policy. We may suspend or end your access where reasonably necessary — for example to protect the service or other users, or if you breach these Terms. Provisions that by their nature should survive termination will continue to apply.

Disclaimers

THABER is provided on an “as is” and “as available” basis. To the extent permitted by law, we do not warrant that it will be uninterrupted, error-free or meet every expectation, and we disclaim implied warranties to the extent the law allows. Nothing here limits rights that cannot be limited under the law that applies to you.

Limitation of liability

To the extent permitted by law, THABER Health is not liable for indirect, incidental, special or consequential losses arising from your use of the service, and our total liability for any claim relating to the service is limited to the amount you paid us for it in the 12 months before the claim (or, if you paid nothing, to the maximum extent the law allows). Nothing in these Terms excludes liability that cannot be excluded by law.

Governing law

These Terms are governed by the laws of the United Arab Emirates, without prejudice to mandatory consumer-protection rights you have in your country of residence. If a dispute arises, please contact us first so we can try to resolve it.

Changes to these terms

We may update these Terms as the service develops. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continuing to use THABER after changes take effect means you accept the updated Terms.

القبول

بإنشائك حسابًا أو باستخدامك ثابر، فإنك توافق على هذه الشروط وعلى سياسة الخصوصية. وإن لم توافق، فلا تستخدم ثابر.

الأهلية

الحد الأدنى لعمر استخدام ثابر هو 13 عامًا. وإن كنت في عمر 13–17 عامًا، فلا يجوز لك استخدام ثابر إلا بإذن من أحد الوالدين أو الوصي القانوني، الذي يجب أن يراجع هذه الشروط ويوافق عليها نيابةً عنك. ولا يجوز لمن هم دون 13 عامًا استخدام ثابر، ولو بإذن أحد الوالدين. وحيث يحدّد قانونك المحلي سنًّا أعلى أو شروطًا إضافية للقاصرين، فإنها تُطبَّق. وباستخدامك ثابر تؤكّد أنك تستوفي هذه المتطلبات.

حسابك

توافق على تقديم معلومات حساب دقيقة والحفاظ على سرية بيانات دخولك. وأنت مسؤول عن النشاط الذي يجري ضمن حسابك. وأبلغنا فورًا إذا كنت تعتقد أن حسابك استُخدم دون إذنك.

ما هي ثابر

تقدّم ثابر معلومات وأدوات للأداء البشري واللياقة — تشمل خطة تدريبية تتكيّف مع الوقت، ورؤى للجاهزية والتعافي، وأهداف تغذية وتسجيلًا تؤكّده بنفسك، وتتبّعًا للتقدّم، ومدرّبًا ذكيًا يجيب على أسئلتك بالاستناد إلى بياناتك.

تمنحك ثابر معلومات وإرشادًا لدعم قراراتك أنت. وهي ليست رعاية طبية ولا تشخيصًا طبيًا ولا جهازًا طبيًا ولا خدمة طوارئ. مارس حكمك الخاص، وفكّر في استشارة مختص مؤهّل قبل بدء برنامج تدريبي أو غذائي أو تغييره جوهريًا. وإن ظننت أنك قد تمرّ بحالة طارئة، فاطلب الرعاية الطبية الطارئة فورًا.

حدود الذكاء الاصطناعي واللياقة

تستخدم ثابر الذكاء الاصطناعي للمساعدة في شرح الإرشاد وصياغته ولتشغيل المدرّب الذكي. وقد يخطئ الذكاء الاصطناعي أو يكون ناتجه ناقصًا، وهو لا يحلّ محل الحكم المهني. أمّا درجات الجاهزية وغيرها من الدرجات المتعلّقة بالسلامة فتنتجها ثابر بمنطقها الحتمي، ولا تتجاوزها صياغة الذكاء الاصطناعي.

يحمل التدريب البدني مخاطر أصيلة. تدرّب ضمن قدراتك، وتوقّف إن شعرت بخطب ما، واطلب المشورة عند الحاجة.

الاستخدام المقبول

توافق على عدم استخدام ثابر بشكل غير قانوني؛ وعدم محاولة تعطيل الخدمة أو الإضرار بها أو الوصول غير المصرّح إليها أو إلى معلومات مستخدمين آخرين؛ وعدم إساءة استخدام الخدمة أو نسخها أو إعادة بيعها أو هندستها العكسية إلا بما يسمح به القانون؛ وعدم تقديم محتوى ينتهك حقوق الآخرين.

محتواك

تبقى لك ملكية المحتوى الذي تقدّمه، كسجلاتك وملاحظاتك وصورك. وتمنح ثابر الترخيص المحدود اللازم لاستضافة ذلك المحتوى ومعالجته وعرضه لتشغيل الخدمة وتقديمها لك — بما في ذلك إرسال سياق ذي صلة إلى مزوّدي خدماتنا كما هو موضّح في سياسة الخصوصية. وأنت مسؤول عن المحتوى الذي تقدّمه وتؤكّد أن لك الحق في تقديمه.

الملكية الفكرية

ثابر وبرمجياتها وتصميمها وعلامتها ومحتواها محمية بحقوق الملكية الفكرية وتبقى ملكًا لنا أو لمرخّصينا. ولا تمنحك هذه الشروط أي حق فيها سوى استخدام الخدمة على النحو المقصود.

الخدمات المرتبطة ومتاجر التطبيقات

قد تتيح لك ثابر استيراد بيانات أو ربط خدمات خارجية — كملف بيانات صحية تصدّره، أو خدمة جهاز قابل للارتداء مدعومة. وتقدّم تلك الخدمات أطراف ثالثة بموجب شروطها الخاصة، وقد تكون بياناتها ناقصة أو متأخرة أو غير دقيقة؛ ولسنا مسؤولين عن خدمات الأطراف الثالثة.

وإذا نزّلت ثابر من متجر تطبيقات Apple، فإن استخدامك للتطبيق يخضع أيضًا لاتفاقية ترخيص المستخدم النهائي القياسية من Apple (EULA). وتحكم شروط الاستخدام هذه خدمة ثابر إضافةً إلى ذلك الترخيص؛ وحيث يتعارض الاثنان بشأن ترخيص التطبيق نفسه، تحكم اتفاقية Apple القياسية ذلك الترخيص.

الاشتراكات والدفع

تقدّم ثابر فئة مجانية واشتراكًا مدفوعًا اختياريًا (خطة Pro) يفتح ميزات إضافية. وإذا توفّر عرض تعريفي أو تجربة مجانية، تُعرض شروطه وأهليته عند الشراء؛ ولا نَعِد بتجربة حيث لا تُقدَّم.

على أجهزة Apple. إذا اشتريت اشتراكًا في تطبيق ثابر على جهاز Apple، يتم الشراء عبر مشتريات Apple داخل التطبيق ويُحصّل من حساب Apple الخاص بك. ويُعرض اسم الاشتراك وما يتضمّنه ومدة الفوترة والسعر في شاشة شراء Apple، بسعر Apple المحلّي، قبل تأكيدك. ويتجدّد الاشتراك تلقائيًا ويُحصّل من حساب Apple خلال 24 ساعة قبل نهاية كل مدة، ما لم توقف التجديد التلقائي قبل ذلك بـ 24 ساعة على الأقل. وتدير الاشتراك أو تلغيه من إعدادات حساب Apple (الإعدادات ← اسمك ← الاشتراكات)، ويمكنك استعادة عملية شراء سابقة من داخل التطبيق. وتتولّى Apple الاستردادات وفق سياساتها؛ وتُقدَّم الطلبات إلى Apple ولا يمكننا ضمان الموافقة. وحذف تطبيق ثابر أو حسابك في ثابر لا يلغي اشتراك Apple — يجب إلغاؤه من حساب Apple، وإلا ستستمر Apple في محاسبتك.

على الويب. إذا اشتركت عبر الويب، تُعالَج المدفوعات عبر Stripe، ويُعرض السعر ومدة الفوترة قبل تأكيدك؛ ويمكنك الإلغاء من داخل ثابر لإيقاف التجديدات المستقبلية.

وفي جميع الأحوال تحتفظ بالوصول المدفوع حتى نهاية المدة المدفوعة الحالية، ولا تحصّل ثابر منك رسومًا في غياب اشتراك مدفوع نشط. ولا تتأثّر حقوقك الاستهلاكية القانونية — بما في ذلك أي حقوق للعدول أو الاسترداد مطبّقة حيث تقيم.

الإنهاء وحذف الحساب

يمكنك التوقّف عن استخدام ثابر في أي وقت وحذف حسابك من داخل التطبيق؛ ويتبع حذف الحساب فترة سماح مدّتها 30 يومًا قبل الحذف الدائم، كما هو موضّح في سياسة الخصوصية. ويجوز لنا تعليق وصولك أو إنهاؤه عند الضرورة المعقولة — مثلًا لحماية الخدمة أو المستخدمين الآخرين، أو إن خالفت هذه الشروط. وتستمر البنود التي يقتضي طابعها البقاء بعد الإنهاء في السريان.

إخلاء المسؤولية

تُقدَّم ثابر «كما هي» و«كما هي متاحة». وبالقدر الذي يسمح به القانون، لا نضمن أن تكون دون انقطاع أو خالية من الأخطاء أو أن تلبّي كل توقّع، ونخلي مسؤوليتنا من الضمانات الضمنية بالقدر الذي يسمح به القانون. ولا يحدّ شيء هنا من حقوق لا يمكن الحدّ منها بموجب القانون المطبّق عليك.

تحديد المسؤولية

بالقدر الذي يسمح به القانون، لا تتحمّل ثابر هيلث المسؤولية عن الأضرار غير المباشرة أو العرضية أو الخاصة أو التبعية الناشئة عن استخدامك للخدمة، وتقتصر مسؤوليتنا الإجمالية عن أي مطالبة تتعلّق بالخدمة على المبلغ الذي دفعته لنا مقابلها خلال 12 شهرًا قبل المطالبة (أو، إن لم تدفع شيئًا، إلى أقصى حدّ يسمح به القانون). ولا يستثني شيء في هذه الشروط مسؤولية لا يمكن استثناؤها بموجب القانون.

القانون الحاكم

تحكم هذه الشروط قوانين دولة الإمارات العربية المتحدة، دون المساس بحقوق حماية المستهلك الإلزامية التي تتمتّع بها في بلد إقامتك. وإذا نشأ نزاع، فيُرجى التواصل معنا أولًا لنحاول حلّه.

التغييرات على هذه الشروط

قد نُحدّث هذه الشروط مع تطوّر الخدمة. وإذا أجرينا تغييرات جوهرية، سنحدّث تاريخ السريان أعلاه، ونقدّم إشعارًا إضافيًا حيث يكون مناسبًا. واستمرارك في استخدام ثابر بعد سريان التغييرات يعني قبولك الشروط المحدَّثة.
